END-USER LICENSE AGREEMENT

The data services accessible through the App are provided to you for your safety. Access to the Services on the App is subject at all times to the terms and conditions agreed between you and our agency.

This end-user licence agreement (EULA) is for the Driveset App, including all mobile application software, third party data and associated media (App). It is a legal agreement between you, the person who downloaded the App or is using it (End-user or you) and Driveset..

Your Insurance Provider will cover your insurance and provide services which relate to you.

FOR YOUR SAFETY YOU MUST NOT USE THE APP IN A WAY THAT INTERFERES WITH YOUR CONTROL OF YOUR VEHICLE, OR OTHERWISE ENDANGERS YOUR SAFETY OR THE SAFETY OF OTHERS. THE APP AND SERVICES ARE NOT DESIGNED, INTENDED OR MANUFACTURED FOR HIGH RISK ACTIVITIES, INCLUDING, AIR TRAFFIC CONTROL, RELIANCE ON THE POSITIONAL ACCURACY OF THE APP FOR PRECISE NAVIGATION, OR WHERE THE USE OR FAILURE OF THE SERVICES COULD LEAD TO DEATH, PERSONAL INJURY OR ENVIRONMENTAL DAMAGE.

1. Acknowledgements

1.1   We will license the App to you subject to the terms contained in this EULA and any rules or policies (Appstore Rules) applied by any appstore provider or operator from whose site, as applicable, you downloaded the App (Appstore). We do not sell the App to you. We remain the owners of the App at all times.

1.2   Any Driveset products or services you purchase will be subject to the relevant terms and conditions notified to you at the point of purchase. The Services are at all times subject to the terms and conditions of your Provider Contract.

1.3   From time to time updates to the App may be issued through the Appstore. Depending on the nature of the update, you may not be able to use the Services until you have updated to the latest version of the App and accepted any new terms.

1.4   Driveset reserves the right to make changes to the App or EULA from time to time and you will be asked to accept any new terms when next logging in to the App.

1.5   You acknowledge that your InsuranceProvider may be responsible for supplying you with the Insurance services to enable you to benefit from the Services facilitated by this App. Unless we are your Insurance Provider, we will not be liable to you for any loss suffered by you relating to your use of the Services or the Technology.

1.6   The availability of the Services is subject to activation of Technology supplied to you under your Provider Contract.

1.7   The App may contain links to other independent third-party apps or websites (Third-party Sites). Third-party Sites are not under our control, and we are not responsible for and do not endorse their content or the privacy and security of these websites. You will need to make your own independent judgement regarding your interaction with any Third-party Sites, including the purchase and use of any products or services accessible through them or where you submit any personal data to these websites.

1.8   Before downloading the App, you should obtain permission from the owner of the mobile telephone or handheld device onto which you have downloaded the App (Device) if this is not you. You accept responsibility in accordance with the terms of this EULA for the use of the App in relation to any Device, whether or not it is owned by you. If you give us information about another person, in doing so you confirm that they have given your permission to provide it to us and for us to be able to process their personal data in accordance with the terms and conditions of this EULA.

2. Privacy Policy

2.1   Your Insurance Provider will be data controller in respect of all personal data processed in the provision of the Insurance Services. If we are not your Insurance Provider, then we are a data processor in accordance with our contract with your Insurer. Please see the terms and conditions of your Provider Contract for further details of how your information might be collected and used, including any fair processing notice.

2.2   There are limited circumstances where personal data might be collected or processed through a function of the App or the Device. In these circumstances we might be deemed to be data controllers for the purpose of the Data Protection Act. Whether we operate as data controller or data processor, we shall always process your personal data securely and in accordance with our Privacy Policy.

2.3   Information we may collect from you via your Device or the Appsite may include:

(a)   Information you provide (Submitted Information) You may give us personal details such as your name, email address or other contact details, membership number, vehicle registration number and other information about you or your vehicle either on the App or when contacting us directly.

(b)   Information we collect about you and your Device The App may automatically collect or you may receive a permission request in respect of:

(i)   technical information, such as the type of mobile device you use, a unique device identifier, mobile network information, your mobile operating system, the type of mobile browser you use (Device Information);

(ii)   information stored on your Device, such as contact information, login information, and other digital content (Geo-location)

(iii)   details of your use of the App and other communication data, and the resources that you access (Log Information).

(c)   Information we receive from other sources (Third Party Information) We may obtain information from third parties (including, for example, your Insurance Provider (if this is not us), Appstores, analytics providers, business partners or third party providers of technical services) and may receive information about you from them. This includes information you provide when you register to use the Services, download or register an App, subscribe to any of our services, search for an App or service, make an in-App purchase, or share data via an App's social media functions.

(d)   Unique application numbers: when you install or uninstall a service containing a unique application number or when such a service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.

2.4   What We Do With Your Information

(a)   By submitting your personal data, you agree to us collecting, storing and processing your data to comply with our contract with us and your Insurance Provider and to facilitate the provision of the Services to you;

(b)   some data may be gathered periodically to facilitate the provision of software updates, analytics, support for or improvements to the App and other services related to the App;

(c)   some data may be aggregated into a form where it ceases to be personal data (i.e. it no longer identifies you) and used with other information we have collected or otherwise used for analytics purposes. We use data which has been anonymised and aggregated information for a wide range of purposes for the benefit of you and third parties. As well enabling us to improve the quality of our App, our products and/or services, we may use this to develop statistical analysis of usage patterns and driving behaviour statistics, new services, inform marketing strategies or for other purposes that we may deem appropriate. No personal data, i.e. data from which we can identify you as an individual, will be used for this purpose.

2.5  Keeping your information secure and where we store it

(a)   All information you provide to us is stored securely by our third party provider of hosting services and hosted within the cloud facilities. We use a variety of security measures, including sophisticated encryption and authentication tools to maintain the safety of your information.

(b)   Where your data is accessed depends on the jurisdiction which applies to your Provider Contract. The data that we collect from you may be transferred from, and accessed by at, the territory you are based in or as otherwise notified to you by your Insurance Provider.

(c)   Any information you submit to us via the App may be stored on your Device in unencrypted form. You agree that the onus is on you to password protect access to your Device to ensure that the information stored on your Device remains secure.

(d)   You should be aware that communications over the internet are not secure unless they have been encrypted. We cannot accept responsibility for any unauthorised access or loss of personal information that is beyond our control, including access or loss caused by your failure to password protect access to your Device.
